St. Petersburg International Legal Forum in Paris

The next Guest Conference under the auspices of St. Petersburg International Legal Forum was held in Paris on November 14-15. Paris became the forth “legal capital” that welcomed the Forum after successful Conferences in London, The Hague and Rome what demonstrates the validity of this project designed to strengthen legal dialogue and enhance collaboration between Russia and foreign countries.

The initiative to hold St. Petersburg International Legal Forum was launched four years ago. For many people including organizers it was hard to believe in its success. In 2014 the Forum will be held for the fourth time. Last year more than 2,500 delegates participated in the event. If we count media representatives, volunteers and translators the number of the Forum participants will increase by several thousands. This year is also special because of conferences under the auspices of St. Petersburg International Legal Forum. Guest Conference in Paris is the fourth in ‘the travelling Forum’ history. The event format facilitates communications with foreign colleagues during the whole year.

On November 14 a solemn reception was given for the delegates of the Guest Conference under the auspices of St. Petersburg International Legal Forum in the Residence of the Ambassador Extraordinary and Plenipotentiary of Russia to France Alexander Orlov which is situated in Hôtel d’Estrées, mansion founded in the beginning of the XVIII century for Duchess d’Estrées.

On November 15 two discussion sessions were held in premises of the High Council of French Notariat on Boulevard de la Tour-Maubourg, namely, 1) Presentation of the key novels in the legislation of the Russian Federation regulating civil transactions and investments; 2) Presentation of the key novels in the legislation of the French Republic regulating civil transactions and investments.

The Conference began with an official opening ceremony during which Jean Tarrade, President of the High Council of French Notariat, Yury Lyubimov, State-Secretary — Deputy Minister of Justice of the Russian Federation, Vincent Lamanda, President of the Court of Cassation of the French Republic, Igor Artemyev, Head of the Federal Antimonopoly Service of the Russian Federation, and Frederic Baab, Diplomatic Advisor to the French Minister of Justice, gave their welcoming speeches.

On January 1, 2014, we will begin implementing new electronic services for legal entities. With that said, entrepreneurs are already able to submit a registration application online. According to the World Bank, we have successfully introduced measures to boost the efficiency of working with taxpayers in recent years. The current priority of our service is to perfect electronic interaction. In that vein, one of our achievements is the introduction of a system for pre-trial settlement of tax disputes in 2009. The number of cases reviewed in court is decreasing.

Tatyana Andryeeva, Deputy Chairman of the Supreme Commercial Court of the Russian Federation, moderated the first session. Speakers of the session, Oleg Shilochvost, Judge of the Supreme Commercial Court of the Russian Federation, Sergey Arakelov, Deputy Director of the Federal Tax Service of the Russian Federation, Andrey Tsarikovskiy, Deputy Director of the Federal Antimonopoly Service of the Russian Federation, Svetlana Nechaeva, Director of the Employment Department of the Ministry of Labour and Social Protection of the Russian Federation, and Emmanuelle Hoffman, Vice President of the UNIFAB, addressed efficiency of work with taxpayers, Russia’s WTO accession, harmonization of the Russian legislation in international practice, defense of intellectual property.

In the beginning, Tatyana Andreeva noticed that “the experience of France is commonly used in the Russian arbitrage legislation”. O. Shilochvost also expressed confidence that “we should behave with civil law as carefully as our French colleagues”.

France is as attractive a country for investors as ever, regardless of the high cost of providing for business activity. France’s state investment bank, for example, offers a range of measures to support investment in the country’s economy. The IFA also provides a wide array of consulting services and is always open to cooperation and offers from clients.

In the course of the second session under the chairmanship of Serge Pascault, Russian-French Cooperation Coordinator of the High Council of French Notariat, speakers addressed issues of financial law, international arbitration, foreign investments and their notary aspects.

In particular, Mr Pascault stressed that “today we pay much attention to attracting Russian investment into France”.

The guests of the Conferences heard the opinions of Bruno Petit, President of the Chamber of Commerce of the Court of Cassation of the French Republic, Bertrand Buffon, Chief of Cabinet of Invest in France Agency (IFA), Bertrand Debosque, President of the European and International Affairs Committee of the French Bar Council, Aude Ab Der Halden, Vice-Director of the Economic Law Division of the Ministry of Justice of the French Republic, and Vincent Roussel, Representative of the High Council of French Notariat.

The Conference brought together more than 150 guests.

In my opinion, it is crucial that we could show ourselves off really well, as a professional formed community. I have two wishes, namely, maximum and minimum: minimum is to learn from the colleagues from the countries where the Conference takes place effective sources of information about legal system, branches of law, their peculiarities. The SUE “Vodokanal of St. Petersburg” is an enterprise with a rich experience in international investment cooperation inter alia with the French partners. Among our major contractors and consultants from France I can mention such firms as OTV, Veolia Water, Degremont, Salans, Vivendi Water, General des Eaux.

French experiences in sanitary engineering and infrastructure private financing, concession and PPP were very helpful for us.

The Forum gave me a chance to share our experience of a successful implementation of PPP projects in St Petersburg, first and foremost, a construct completion project of South-West Water and Wastewater Treatment Facilities in 2002-2005. It is particularly essential that the project has been implemented without any special legislation and was based on regulations of the Civil Code of the RF.

The Guest Conference in Paris by St. Petersburg International Legal Forum has confirmed once again the total accuracy of the chosen format that allows every participant to find the most appropriate way to communicate with his colleagues. It is both a “doctrinal dialogue” for theorists of law and practical decisions for practicing lawyers. It is also, what is very significant, an opportunity for direct communication between businesses and regulators regarding the most urgent and essential matters. Needless to say that it gives a chance to meet old friends at the Forum’s venue. This “multidimensionality”, in my opinion, is a guarantee of permanent interest towards the Conference on the part of its numerous participants.
