St. Petersburg International Legal Forum in Rome

On March 22, 2013 the capital of Italy welcomed the participants of the travelling St. Petersburg International Legal Forum. The Forum in Rome was the third in succession of the guest Forums organized on behalf of the Ministry of Justice of the Russian Federation.

When the theoretical possibility of this event was being discussed, we could not even imagine how big the interest will be and how many people there will be in the conference-hall. The first round table topics are mostly general; its main task is to minimize the lack of information about the legal systems of our two countries. The second session which describes the receiving party concerns the cultural heritage preservation. I wish Russian cities were as well kept as the Italian ones. Italian legislation on cultural goods protection is a perfect model to emulate.

The programme of the guest Conferences under the auspices of SPILF is traditionally concentrated on one topic. The Forum held in London on January 29, 2013 was dedicated to international financial centers and investment arbitration. During the Conference in The Hague on the 6th of March the questions of mediation and other dispute resolution methods were discussed. This time the issues of economics and justice in the business medium and of some legal aspects of historical and cultural heritage preservation were put on the agenda.

The Forum’s venue was the Conference-hall in the Temple of Hadrian — a sanctuary to the deified Emperor Hadrian founded in the II century AD. Nowadays the Temple’s ruins are incorporated into a later building in the Piazza di Pietra.

The Conference was started with the opening speech of the President of the Institute for International Political Studies Ambassador Giancarlo Aragona. The Words of Welcome were also given by Antonio Zanardi Landi, Ambassador Extraordinary and Plenipotentiary of the Italian Republic to the Russian Federation, Paola Severino, Minister of Justice of Italy, Michele Vietti, Vice-president of The Superior Council of Magistracy, and Yury Lyubimov, Secretary of state, Deputy Minister of the Ministry of Justice of the Russian Federation, who pointed out that “a history of cooperation between the two countries in the case of Russia and Italy is a history of relationship which continues in spite of all the global crises, wars or political systems differences”.

The new level of economic relationship between our two countries is in process. It should be said that Italy has done a lot in the recent years. We have worked on the legal processes duration reduction and consulted on this issue with our Russian colleagues. Learning from each other should deepen. Therefore I consider this meeting to be really well-timed. Russia and Italy have common legal system traditions grounded in Roman law. I hope that the importance of Roman law will be discussed during the St. Petersburg Forum in May as well. I will participate in this Forum with great pleasure.

The first session titled “Justice and Economics: the reformation of business medium in the Russian Federation” was held under the chairmanship of Yury Lyubimov. The speakers of this discussion were Tatyana Andreeva, Vice-chairman of the Supreme Commercial Court of the Russian Federation, Aurelio Regina, Vice-president of the “Confindustria” confederacy (Italy), Giuseppe Tripoli from The Ministry of Economic Development, and Sergey Arakelov, Vice-president of the Federal Tax Service of the Russian Federation.

At the end of the session the case studies were given by business representatives: Gaetano Casalaina from the “Indesit Company”, Vittorio Loi from the International Legal Company “Pavia e Ansaldo” and Viktor Naboichenko from the Italian company “Enel OGK-5”, a leading integrated player in the power and gas markets.

The topic of the second session “Protection of cultural heritage: legal regulation in Russia and Italy” was especially important for the two countries: both Russia and Italy are the treasure-houses of art masterpieces many of which are considered to be the renowned “Wonders of the World”.

It is utterly important that the legal system provided the functioning of economic system. In the modern world it is necessary to have special courts for commercial structures. And today, during the Forum, we pay much attention to this issue. Our countries should exchange the decisions what will enrich our experiences and will better the legal system functioning in both states. Our states are ready to modernize the judicial systems, therefore we have a programme of the exchange of judges which allows us to cooperate in this direction.

During this session opened by the Moderator — Deputy Minister of Cultural Heritage and Activities Roberto Cecchi — the main experts in this field of Legal Studies gave their opinion on the problem: Giuliano Urbani, Ex-minister of Cultural Heritage and Activities, Secretary of State Yury Lyubimov, Anna Maria Buzzi, Director-General of the Directorate General for the Promotion of Cultural Heritage of the Ministry of Cultural Heritage and Activities, Dr. Andrey Lisitsin-Svetlanov, President of The Institute of State and Law of The Russian Academy of Sciences, Paolo Giorgio Ferri, Magistrate, International Expert in Cultural Goods Juridical Problems for the Ministry of Cultural Heritage and Activities, and Lorenzo Casini, Associate Professor at the Department of Administrative Law in the University of Rome “La Sapienza”.

The guest Forum in Rome was concluded with sizing up and with the closing speech of Gian Maria Fara, President of EURISPES.

On the threshold of the Conference on the 21st of March the Russian-Italian top-level general meetings took place in the heart of the Italian capital. The day was finished with a Reception in the Residence of the Embassy of the Russian Federation in Rome at the villa “Abamelek”.

I would like to express my greatest gratitude to the organizers of St. Petersburg International Legal Forum in Rome. Everything was traditionally organized on the top-level.

I was really impressed by such a serious delegation on behalf of the Supreme Commercial court of the Russian Federation. It is always useful to receive information about the arbitrage practice formation, as the saying goes, straight from the horse's mouth. It is also helpful that now legal acts can be easily found in the official information electronic systems.

I have assured myself of the rightness of the opinion that judges specialization is quite necessary and justified, and this concerns all the legal system levels. The issue of the cultural goods preservation, of the experience of Rome in this question was also close to me.

My native city, St. Petersburg, is also the whole open-air museum, and its historical center is the UNESCO World Heritage. I often meditate if we do enough for its proper preservation. And who else but we, lawyers, should contribute to the normative basis foundation and effective procedures organization with the aim of the historical heritage preservation. The experience of Rome is, for sure, extremely useful in this question.

And, as always, I appreciate the unique opportunity to meet my colleagues, including foreign experts, at such a high level. This gives the greatest experience which cannot be overestimated.

I have also familiarized myself with the programme of the forthcoming Forum in May 2013. I have a note to add, taking into account the results of the already fulfilled Forums, I wish more attention would be paid to environmental issues, for example, there could be a round table dedicated to ecological problems, especially since the year 2013 is the year of environmental protection.

I am very grateful to St. Petersburg International Legal Forum and to the Ministry of Justice of the Russian Federation for the idea of so-called “travelling” Forums.

The Forum in Rome in this regard has a special value for every lawyer, as the Roman law is studied worldwide, and its influence on modern legal reality cannot be overestimated: it is a basis of legal thinking. The private law traditions, rooted in Roman law, continue developing in the Russian legislation as well. Thus, the most progressive regulations of civil law have found use in Russian Civil Code and in the project of its amendments.

The venue — Hall in the Temple of Hadrian, close to the Pantheon — has given the event a special colour, especially since the second session was dedicated to the issue of cultural heritage preservation in Russia and Italy. In particular, I would like to mark out the presentation of Lorenzo Casini, professor at the Department of Administrative Law in the University of Rome “La Sapienza”.

Judging by a crowd of people which attended at the Conference until its end, the presentations of leading Russian and Italian lawyers were important for everybody.

The recent guest Conference in Rome, as the very idea of the Forum’s new travelling format, could be obviously called successful. The legal systems of Russia and Italy are connected with common traditions of Roman law. And it was more interesting to understand what similarities and what differences our two countries share regarding the questions of legal regulation in modern conditions.

The exchange of experiences was extremely useful. It should be mentioned that not only Russian delegates could appreciate the serious and respectful approach towards cultural goods protection in Italy, but the Italian colleagues were also concerned with the experience of Russia in the field of arbitral disputes resolution development and enhancement. This, in fact, explains the advantages of the Forum’s new guest format: in an open dialogue it allows evaluating the other countries’ prosperous experience what considerably develops and improves the national legislation.

With great pleasure I took part at the event “St. Petersburg International Legal Forum in Rome”. The honorable speakers of the first session titled ’Justice and Economics: the reform of business environment in Russia’ presented the interesting reports of legal aspects of conducting the business in Russia, in particular, covered in detail the system of arbitration courts, its practice and implementation of arbitral awards, characterized the matters of tax administration and tax system in Russia, dealt with case studies.

This presentation moderated by Yury Lyubimov, the Secretary of state, Deputy Minister of the Ministry of Justice of Russia, reasserted the interest of the Italian participants to know better the Russian legislation. I hope that this presentation will give a positive impulse to the further development of the relations of both countries.
